RENTAL POLICIES - TRANSIENT OCCUPANCY RENTAL AGREEMENT

IF, AT THE TIME OF ARRIVAL YOU FIND PROBLEMS WITH YOUR RESERVED UNIT, IT IS YOUR RESPONSIBILITY TO CALL OUR OFFICES (800) 962-1489 24 HRS. A DAY AND REPORT THOSE PROBLEMS IMMEDIATELY. ABSOLUTELY NO REFUNDS OR COMPENSATION WILL BE CONSIDERED FOR COMPLAINTS MADE AFTER DEPARTURE

THIS AGREEMENT (herein Form), between the Vacation Rental Guest (herein Guest) and Property Manager. This Form must be accepted by the Guest as “agreed to” and such acceptance shall be on file with Property Manager prior to the release of keys to the Guest.

ARRIVAL - DEPARTURE TIME: Check-in time is 3:00 p.m., check -out time is 11:00 a.m. No exceptions will be made unless authorized by Property Manager in advance and an appropriate notation has been made on the guest's confirmation letter and/or entered on Property Manager's reservation system. Guests arriving before 3:00 p.m. or staying after 11:00 a.m. are subject to an additional night's rent.
 
KEYS: The reservation must be fully paid for and this contract accepted and that acceptance is on file with Property Manager before keys will be released to the Guest. Keys will be available at 3:00 p.m. (3:30 p.m. during holidays) During business hours, keys will be available at the office counter. After business hours, keys will be available inside the key lockbox. Upon departure, keys must be dropped in the key drop slot located at office.

PAYMENTS: The amount as shown to you on the “Reservation Details” page of your online reservation noteated as “Total” will be charged to your credit card immediately upon completing the reservation. There is a three-night minimum on holiday weekends, five night minimum for Christmas and New Years. If you book a holiday less than the minimum, a reservationist will contact you about this booking.

CANCELLATION: The applicable portion of the cancellation policy is dependent upon the time of the cancellation:
1.) If a reservation is canceled 30 days (45 days for holiday periods) or more prior to your check-in date, the amount noted as the "Administration Fee" in your reservation, plus a cancellation fee of $125 will be made against your account.

2.) If a reservation is canceled less than 30 days but more than 14 days (less than 45 days but more than 30 for holiday periods< prior to the stay, an amount equal to 1/2 the rent, plus the amount noted as the "Administration Fee" in your reservation, plus a cancellation fee of $125 is made against your account unless the reservation (in the same unit) is rescheduled within 90 days or the unit is re-rented for the cancelled time period. If a rescheduled reservation is canceled at anytime, all funds are forfeited.

3.) If a reservation is canceled 14 days or less (30 days or less for holiday periods prior to the stay, all of the funds collected are forfeited unless the reservation (in the same unit) is rescheduled within 90 days or the unit is re rented for the cancelled time period. If a rescheduled reservation is canceled at anytime, all funds are forfeited.

If the cancellation is due to announced road closures ONLY, NO cancellation charges will be applied if reservation is transferred to a future date within 90 days, and in the same rental unit. Only one date change is allowed under these circumstances. If rental is paid and you do not show, or you stay less than reserved dates, services shall be considered rendered and no refund will be made. To modify this policy you should consider vacation rental insurance which may cover your deposits and /or costs should someone become ill prior to your vacation.

CONDITIONS BEYOND OUR CONTROL: Property Manager reserves the right to transfer a Guest to a comparable property prior to arrival. should it be necessary and without notice. Guest acknowledges that Property Manager has no control over many situations ; no refunds will be issued for weather, snow or road conditions, power, cable television or telephone outages or other acts of nature, nor is any guarantee or warranty made as to the condition or quality of televisions appliances, and the like. Every reasonable attempt will be made to put them in proper working order during your stay. Some properties could be sold prior to your arrival. Our liability then ends with informing you that the property has sold prior to your arrival date and offering to refund your monies in full or switch your reservation to a comparable property (should one be available) at your choice. Beyond this notification and these options offered, the company shall bear no further response unless otherwise indicated.

HOLD HARMLESS DUE TO EVENTS THAT ARISE FROM NATURALLY OCCURING HAZARDS AND UNFORESEEN AND/OR UNPREDICTABLE OCCURRENCES. Guest is hereby alerted to the fact that certain hazards, and unforeseen and/or unpredictable occurrences are inherent with geographical location of the Tahoe Basin, including but not limited to those that arise from weather, altitude and/or being the natural habitat of wild animals. It is the Guest's responsibility to familiarize themselves with such possible occurrences. Further, Property Manager shall not be held responsible for any latent defects within or without the rental property that are beyond the scope of a diligent search for such defects. Guest agrees to hold Property Manager and/or it's agents harmless in the event of any damage or injury to self or property, or to any additional persons staying with the Guest during this rental or ant other person whomsoever in connection with the rental of the property that results from accident, injury, any effects of snow, ice, flood, defective construction, fire, theft, injury caused by contact with animals, and the like. Property Manager also shall not be liable for any error of judgment or for any mistake of fact or law, or for anything which it may do or refrain from doing hereunder, except in cases of willful misconduct, or gross negligence.

NUMBER OF GUESTS:The number of occupants allowed as overnight tenants is printed on your “Reservation Details. This number includes both adults and children who sleep in their own beds. Any additional Guests beyond this number must be authorized by Property Manager prior to your arrival. You will be charged an additional $100.00 per unauthorized person per night, above this number.

MAXIMUM OCCUPANCY AS PER THE VACATION RENTAL ORDINANCE: Maximum occupancy for each rental unit is posted therein. Over occupancy will result in immediate eviction from the rental with no refund of rent.

PETS: No Pets are allowed without prior approval by Property Manager. Evidence of a pet found in your unit during your stay could be grounds for immediate eviction and NO refund of rent. You will be charged the cost of cleaning the carpets and furniture and for any damages caused by the pet.

LARGE GATHERINGS: Property Manager does not allow weddings. receptions. or lame parties of any kind in or at any of our units. Parties or gatherings of more than twice the number of Guests listed as maximum capacity of your unit will be con­considered as a breach of the content of this Form and could be grounds for immediate eviction and NO refund of rent. Noise output must be strictly controlled, including the volume of any music. No musicians or entertainment is allowed outside. No yelling or loud activity is allowed in the street. Please close windows and doors when possible to help control noise.
DISTURBANCE OF THE PEACE; ILLEGAL ACTIVITIES:Disturbing the peace or disturbance of your neighbors or any illicit activity is a violation of local ordinance. If law enforcement officers are called, come to the unit and fill out a substantiated "disturbance report” or similar complaint, eviction will be immediate and all of your rental funds will be for­forfeited

MISSING OR DAMAGED PROPERTY: If property belonging to the unit and/or Property Manager is found missing or damaged by the Guest, the cost of replacement of or repair to that property plus a $50.00 service charge for each replacement/repair will be made to your credit card.

FIREPLACE USAGE: Do not remove ashes from the fireplace. Ashes will be removed by the housekeeper after your departure. Do not burn tree bark, pine needles, pinecones, cardboard or pressed wood products (i.e., DuraFlame Logs, etc.). Open the fireplace damper before using. (If unit has a gas log fireplace, do not bum anything in the fireplace and be sure gas key is completely turned off after use.) Close fireplace damper only when fire is completely out.

TELEPHONE CALLS: Local and toll-free calls are free of any charges. Tenants making long distance toll-type calls will encounter a call blocking system which will allow the use of most phone calling cards and major credit cards. Should it be found that the call blocking system has been circumvented in any way during your stay, the cost of any long distance calls that appear on the property Owner's phone bill plus a $15.00 service charge will be charged to your credit card.

WINTER SEASON PARKING: If snow removal is in progress. street parking is not permitted by local ordinance. Cars in the way of snow removal equipment on any street are subject to towing, impound fees and parking fines.

GUEST'S RESPONSIBILITIES AT CHECKOUT OF THE RENTAL PROPERTY: At checkout, Guests are expected to do the following: Kitchen: Dishes and cooking utensils cleaned& put away. All food must be removed from the re­refrigerator (including the freezer). Trash: place all trash in the cans or dumpster provided outside the home. Do not place any garbage in plastic bags outside rental home!!! Thermostat must be set at 55 degrees when you leave the home. Return all keys to the office key drop return.
 
ITEMS LEFT IN UNITS BY GUESTS: It is the responsibility of the Quest to notify our office of items left in a unit Check all closets and drawers and look under beds. Personal items found in the Unit will be held for 20 days. A $15 ser­vice charge plus postage will be charged for mailing items back.
 
AFTER HOURS ASSISTANCE: Please call our main office at (530) 544-5300 (local call) or (800) 962-1489 If you require assistance due to your negligence (i.e., lost keys, maps, etc.) you WILL BE CHARGED at the rate of $15.00 per hour (1 hour minimum). All Guests are responsible for getting everyone in their group to the unit.

DISSATISFACTION WITH THE UNIT: If the rental home is found unsatisfactory upon arrival. you MUST notify our offices immediately. During normal business hours, you may reach us at (530) 544-5300 (local call) or (800) 962-1489 (out-town) Your choice of options will be: 1.) We will make every reasonable attempt to rectify the problem with the Unit you are in; 2.) We will move you to another comparable Unit, if one is available. Charges for any restocking, cleaning and/or repairs required as a result of your entering the unit will be charged to your credit card. If you stay in the unit longer than 2 hours without notifying us of your dissatisfaction, Property Manager will assume that you are satisfied with the accommodations and only option 1.) above will be available to you.

VACATION RENTAL ORDINANCE: Guest is hereby made aware of the Vacation Rental Ordinance currently in force in South Lake Tahoe. Any violation of that Ordinance which results in the issuance of Notification Of Violation by any authority thereof shall result in the immediate eviction of the Guest, the forfeiture of all moneys collected and an additional assessment of $500.00 to the Guest. LEGAL JURISDICTION:In the event of any legal action whatsoever, made the by either Property Manager or the guest (and/or any member of their party), arising from this reservation, it is hereby agreed by these parties that the courts of proper jurisdiction in these matters shall be those located in the City of South Lake Tahoe, for El Dorado County, CA
 
Severability: Should any provision of this contract be found to be void, voidable, illegal or in other way unenforceable, all other provisions herein shall remain in full force and effect.
 
Entire Contract:The foregoing is the entire contract between parties hereto. No other statements, promises, verbal agreements, assumptions and/or understandings are part hereof.
 
I HAVE READ THIS ENTIRE CONTRACT AND AGREE THAT I AM RESPONSIBLE FOR ALL OF THE ABOVE RULES. I AGREE TO BE RESPONSIBLE FOR ALL DAMAGES CAUSED BY MY PARTY. Property Manager HAS MY EXPRESS PERMISSION TO AUTHORIZE MY CREDIT CARD FOR A SECURITY DEPOSIT IN THE AMOUNT OF $300.00. I UNDERSTAND THAT, SHOULD IT BE NECESSARY, THIS AUTHORIZATION WILL BE UTILIZED BY Property Manager TO CHARGE ME FOR ANY DAMAGES, ANY LONG DISTANCE TELEPHONE CALLS, MISSING ITEMS, ANY EXTRAORDINARY CLEANING TO THE UNIT AND ANY CHARGES ARISING FROM ANY VIOLATION OF THE VACATION RENTAL ORDINANCE BY MYSELF OR ANYONE IN MY PARTY IN THE AMOUNTS DESCRIBED HEREIN. SHOULD CHARGES FOR THESE DAMAGES, ETC. EXCEED THE INITIAL AUTHORIZATION OF $300.00, I HEREBY GIVE Property Manager MY EXPRESS PERMISSION TO CHARGE MY CREDIT CARD FOR THE BALANCE OWED. I FUTHER AUTHORIZE Property Manager TO CHARGE MY CREDIT CARD FOR ANY OUTSTANDING BALANCES DUE PRIOR TO ARRIVAL.
